The Department of Environmental Protection promulgated a newly revised Chapter 102 regulation package in August 2010 with an effective date of November 19, 2010.
These regulations provide for new erosion and sedimentation control measures for earth disturbance activities associated with agricultural activities and land development activities. The regulations also provide for NPDES permitting requirements associated with earth disturbance activities greater than 1 acre which include post-construction stormwater management controls, long-term operation & maintenance requirements and riparian forest buffers where applicable. This presentation will highlight the new Chapter 102 regulations and associated requirements.
The United States Environmental Protection Agency had promulgated new effluent limit guidelines (ELGs) for construction activities related to turbidity in 2009 with a phase-in period established over several years. The new guidelines were challenged by the National Association of Home Builders on the scientific basis of the turbidity limit. The guidelines were remanded back to the US EPA for revision which was recently concluded. This presentation will provide insight into the proposed turbidity revision and current status of the agency's final review for publication.
