A. STATEMENT OF PURPOSE
The Federal Highway Administration (FHWA) hereby requests applications for assistance from all interested parties to result in the award of a Cooperative Agreement (Agreement) to support the establishment and maintenance of a Center for Environmental Excellence (Center).
B. LEGISLATIVE AUTHORITY
Section 5309 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), Public Law Number 109-59, 119 Stat. 1812 (August 10, 2005), establishes four Centers for Surface Transportation Excellence.
Section 5309(b) establishes the goals of the centers:
(b) Goals - The goals of the centers for surface transportation excellence are to promote and support strategic national surface transportation programs and activities relating to the work of State departments of transportation in the areas of environment, surface transportation safety, rural safety, and project finance.
Section 5309(e)(2) requires that each center develop a strategic plan:
(2) Strategic Plan – The Secretary shall require each center to develop a multiyear strategic plan that describes – (A) the activities to be undertaken; and (B) how the work of the center is coordinated with the activities of the Federal Highway Administration and the various other research, development, and technology transfer activities authorized by [Title 23]. Such plans shall be submitted to the Secretary by January 1, 2006, and each year thereafter.
Section 5309(c)(1) describes the role of the Center:
(1) Environmental Excellence -To provide technical assistance, information sharing of best practices, and training in the use of tools and decision-making processes that can assist States in planning and delivering environmentally sound surface transportation projects.
Section 5309(d)(2)(A) authorizes funding of $1,250,000 for each fiscal year to establish the Center.
Section 5309(d)(3) provides that funds authorized for this section shall be available for obligation in the same manner as if such funds were apportioned under chapter 1 of title 23.
